Supreme Court Dismisses PIL To Cancel Offline Board Exams Of Class 10 and 12 Of CBSE, ICSE and State Boards; Says ‘Such Petitions Give False Hopes To Students’

The Supreme Court on Wednesday pushed aside a plea in search of cancellation of bodily tests for Class X and XII to be performed by way of all State Boards, CBSE, ICSE and National Institute of Open Schooling (NIOS), pronouncing such petitions provide false hope to students and only create extra confusion. A bench headed by means of Justice AM Khanwilkar slammed the petitioner’s counsel for submitting such a plea saying authorities are extra aware of the floor realities and are capable of taking a choice with which the court ought to no longer interfere.


“Such petitions provide false hopes to students. Entertaining such petitions is solely increasing confusion in the system. What variety of petitions are being filed?” asked the apex court.
The bench said its closing year’s order on suspending of examination can’t end up a norm to omit the equal order for this tutorial year also.
“This petition is ill-advised and premature. Authorities are but to take a selection for exam guidelines and dates in respective boards.

If decisions are not in accordance with guidelines and Act it will be open to aggrieved persons to venture in that regard,” stated the bench while pushing aside the plea.
The apex courtroom said it was once refraining from imposing a cost, however added that if the petitioner once more filed such petition exemplary prices would be imposed.

“This has to stop. Don’t come up once more or there will be exemplary costs. Let students and authorities do their job. You can not PIL like this,” the bench informed advocate Prashant Padmanabhan acting for petitioner toddler rights activist Anubha Shrivastava Sahai.

The petition sought instructions to the State Boards, CBSE, ICSE, NIOS who are going to conduct board exams for X and XII in offline mode to bypass a notification regarding alternate mode of assessment instead of offline exams. The petition has also sought the comfort of the constitution of a committee for figuring out the method of evaluation of students inclusive of compartment college students and declaring the result within a time limit and deadline.
