Emami Agrotech Ltd – the edible oil and foods arm of Emami Group – is engaged in manufacturing, sales & marketing of a range of cooking oils, soya chunks, and spices under brand name “ Emami Healthy & Tasty”, “Advans” & “Mantra”.
Emami Agrotech has filed a complaint in the Howrah civil court in West Bengal, claiming that Marico Ltd’s advertisement of Saffola Soya chunks as “Bharatborsher sobcheye naram ar sushsadu soya” (Bengali) is misleading, demeaning, and disparaging not only their soya chunks but other soya products across India. The advertisement is misleading, claiming it devalues their soy products and harms their brand image.
The Howrah civil court has ordered a temporary injunction on the advertisement, arguing that it is misleading the public. The Howrah Civil Court said in its order dated October 18, 2023, that “the defendant or company is restrained from broadcasting or telecasting the impugned advertisement depicting that their soya chunks are the best products amongst all similar competing products across India till November 23, 2023.”
